What Pregnancy Discrimination Looks Like

Pregnancy discrimination is a type of workplace discrimination that can take many forms:

  • When an employer fails to hire a pregnant woman
  • When an employer fires a woman after announcing her pregnancy
  • When an employer denies a promotion to a pregnant woman
  • When an employer disciplines a pregnant worker for taking time off for doctor's visits

What Pregnancy Accommodations Can I Reasonably Request?

Pregnant workers have a legal right to request reasonable accommodations due to limitations or complications associated with being pregnant. Employers are legally obligated to provide these accommodations as long as it does not impose an undue hardship, either financially or if the changes are too complicated to enact.

Some examples of pregnancy accommodations that you can request include:

  • Light duty requests
  • Alternative assignments, such as reassigning lifting tasks that a pregnant worker should not perform
  • Additional breaks
  • Modified work schedule
  • Ergonomic office furniture
  • Moving a pregnant worker's desk closer to the restroom
  • Allowing work-from-home

If you are requesting accommodations, you should do so in writing so that you have a record of the request in the event that you may need it for a pregnancy discrimination case.

Retaliation For Using Maternity Leave

In many cases, pregnancy discrimination manifests itself in relation to maternity leave. A woman may take leave, have her child, and then return to work only to find that her job is not waiting for her. While the employer may provide any number of reasons for the wrongful termination, it may be a sign of retaliation for using maternity leave.

Sometimes, an employer may attempt to either deny or limit maternity leave or pregnancy-related sick time. The woman may feel forced to quit in order to protect the health of her unborn child.
