In the United States of America, every state is allowed to set its own laws for wages and hourly pay, so long as it aligns with the federal boundaries of the Fair Labor Standards Act (FLSA). This is not the case in Texas, however, as our state utilizes the exact hourly minimum wage of the current federal standard, which has been in effect from July 24, 2009. The rate of minimum wages in Texas, therefore, is $7.25 an hour.
While it should be simple enough to pay employees at a rate which at least hits this minimum, there are many employers who are unfortunately mistaken in their beliefs regarding salaries. They assume that employees who are paid with salaries rather than a normal hourly wage do not get Texas overtime pay. However, this is not lawful by FLSA guidelines, and almost all salary-paid employees who work overtime should be paid for this labor with the appropriate overtime rate.
