Large corporations hire thousands of people. Inevitably, despite all of the safety information, some workers in Texas and elsewhere are going to get hurt. The injured employees, in turn, fill out workers' compensation paperwork so that they are able to receive covered medical care and income while they are taking time away to heal. Some companies decide to fire the employees instead, prompting the worker to file a wrongful termination claim.
A worker for Wal-Mart in another state claims that she was fired after she was hurt on the job. The woman alleges that she worked in the bakery department and fell after walking across a recently mopped floor. The fall caused injuries to her back, and she subsequently filled out workers' compensation paperwork.
The plaintiff alleges she informed Wal-Mart that she had back surgery scheduled a little over a month after the accident. However, the woman was fired before she was able to have the procedure. Store employees accused the plaintiff of stealing cakes, but the plaintiff contends that the accusations are false.
According to the plaintiff, she received a wrongful termination because she had filed a workers' compensation claim. For her claim, she is asking the court to award her legal fees and monetary damages. There are many reasons that Texas employees can be fired which are in accordance with state and federal employment laws, but retaliation is not one of them. In successful cases, the workers may be awarded lost wages, monetary damages, and even be reinstated into their former position, if desired.
