A company is being sued by a Texas employee for allegedly violating the Americans with Disabilities Act. The Denton County resident claims that he was wrongfully discharged after being employed with Ampco Products Co. from Aug. 7 to Nov. 30, 2012. According to reports, the employee was harassed and humiliated because of his disability, the nature of which was not reported.
The accusations against this employer include intentionally discriminating against the plaintiff based on his disability and subjecting the employee to willful harassment. There is an allegation that the company allowed a hostile work environment to exist. The company may be held responsible for the behavior of other employees if the managers or owners were aware of the problems and failed to take steps to stop the behavior.
According to the claim that was filed on March 24, the plaintiff is seeking compensation from the company as well as punitive damages, costs, and associated fees. The case is being heard in the Sherman Division of the U.S. District Court for the Eastern District of Texas.
Employers are required to provide reasonable accommodations under the Americans with Disabilities Act of 1990.
