There are several employment laws in place to protect workers when they suffer from illnesses that take them away from work for extended periods of time. One of the most common is the Family Medical Leave Act, which allows employees to take a specified amount of time away from work when their conditions or situations fall within the covered parameters of the law. Texas workers who take advantage of any of these laws and then suffer disability discrimination or retaliation because of them may decide to look to the law to protect them.
A woman who worked for AT&T is claiming that she was retaliated against because of her illness. The plaintiff -- who has multiple sclerosis -- worked for the company from 2000 until her termination in 2013. In 2012, she took an approved short-term disability leave.
The plaintiff claims that she returned from her leave early after she was threatened with losing her job. She was told that she would be terminated for insubordination if she did not return to work. The woman claims that she was suspended without pay and was accused of misappropriating the company's money, even though her leave was approved.
A month after the plaintiff filed a complaint with the Equal Employment Opportunity Commission, she was fired. The Texas woman claims that the company retaliated against her and violated the Americans with Disabilities Act, as well as the Family Medical Leave Act. She is seeking her lost income, legal fees and monetary damages in her case.
