There are many different ways that workers can become the victims of sexual harassment that are not always physical. Regardless, reporting cases of sexual harassment should never result in backlash. A woman who worked for a paint manufacturer outside of Texas claims that after she reported sexual situations in the workplace, she faced retaliation.
The plaintiff alleges that during her tenure, she suffered sexual advances and harassment. According to her lawsuit, one of her co-workers noticed a camera was placed in the woman's restroom. This was purportedly done by another employee. The plaintiff took matters into her own hands and reported the camera to her superiors. Once she came forward about the situation, she claims that everything at work began to change.
After reporting the camera, the plaintiff was demoted, but this was not enough to stop her from continuing to speak up. Later, she complained to the police and allegedly faced retaliation again. This time, the woman was trying to get a promotion for which she was qualified, but she was passed over in favor of another candidate.
She filed her complaint in a federal court against her employer for retaliating against her after reporting sexual harassment. The defendant is also being accused of violating the Pennsylvania Human Relations Act and the Civil Rights Act of 1964 for discriminating against her because of her gender. The plaintiff is seeking over $150,000 in damages for her ordeal. All employers in Texas and elsewhere should strive to have a work environment free from hostility. Workers who report inappropriate situations should be able to come forward without fear of adverse employment actions, and, if that occurs, they are within their legal rights to take action.
